Adirondack Park Agency Variance Referral Letters

Not all ZBA actions result in a referral to the Adirondack Park Agency. ZBA denials are not referred. Some ZBA variances granted are APA non-jurisdictional, meaning they are not subject to APA review. If the ZBA is certain the variance is not subject to APA review, no referral will be made.

The Adirondack Park Agency is not required to respond to a referral. If it does not respond within 30 days of receiving a complete referral, the ZBA variance stands. If the APA responds, it generally responds in the following ways:

No action: The APA is simply acknowledging the referral.
Non-jurisdictional: The ZBA variance is not covered under the Adirondack Park Agency Act.
Reversal: The APA has overturned the ZBA variance.
Stop Clock: The APA determined that the referral documentation is incomplete and the APA needs more information to proceed. The 30-day clock is stopped and will resume when the APA receives the information requested.
