Dear Planning Board Members:
In accordance with Article 11, Section III(B)(8)(a) of the Town of Caroga Zoning Ordinance, the Caroga Zoning Board of Appeals is requesting the Planning Board to make a recommendation on Zoning board of Appeals Application Z2019-07. The details and all correspondence relative to this application can be found on the Town of Caroga website under departments, Zoning Board of Appeals, ZBA Applications, Documents and Correspondence.
As background, this application became necessary with the change in the dock permitting process with the ordinance enacted on January 1, 2019. Prior to this time, the only reference concerning docks was the exemption from docks meeting the shoreline setback requirements. The approval for dock permits in the town required prior approval from the NYS Department of Environmental Conservation and the Army Corps of Engineers. With the approvals in hand, the Code Enforcer had authority to issue the permits. Under the current Zoning Ordinance, docks are covered as a use allowed by right. This property is zoned R-10 which does not allow for use by right for docks. This is one of what would appear to be some fifteen (15) properties on East Stoner Lake not zoned as one of the lakefront zones allowing for docks as a use by right. The property owners initiated the dock permitting process for this property in August of 2018, prior to the enactment of the current zoning ordinance.
