The property owner proposes to build a 10-foot X 20-foot Accessory Structure.

Planning Board consideration involves the following section(s) of the local zoning ordinance:

Article 4, Subsection II, Paragraph C; A use listed in the Use Table as subject to Special Use Permit approval for a given zoning district shall be allowed in that district when approved in accordance with Article 7 hereof, provided all other requirements of this Zoning Ordinance are met.

Zoning Board consideration involves the following section of the local zoning ordinance:

Article 9, Subsection VI, Paragraph B; Where two-thirds of current minimum yard setbacks and other dimensional requirements cannot be met, the owner shall have the right to apply for one or more area variances. The Structure would be placed on the property line of adjoining parcel 52.14-2-13.2.

If a variance is granted by the Zoning Board of Appeals, The Adirondack Park Agency will then have a chance to review and respond to the site plan. Lastly, the Code Enforcement Officer will make final recommendations regarding the issuance of a building permit.
