Notice of Decision from the Zoning Board of Appeals

Notice of Decision in the Matter of a Request for a Variance for

Application Number: Z2018-09

Owner: Tracy Maddocks 444 Sprout Brook Road Garrison NY 10527

Of the Property located at: 224 South Shore Rd. West Caroga Lake NY 12032

and identified as parcel #82.12-1-2

for an after the fact variance to the Town of Caroga Zoning Ordinance which is in violation of Side Yard Setbacks, and the percentage of ground cover allowed in this zoning district.

Owner also desires to be permitted to keep a previously approved carport which he enclosed, and is looking to get a variance for the other unpermitted structures placed in the shoreline setback.

PLEASE TAKE NOTICE: that a meeting of the Zoning Board of Appeals of the Town of Caroga was held on August 30, 2018

The Zoning Board of Appeals application in the above matter was APPROVED, subject to the following stipulations:

  1. Applicant must combine the two adjacent parcels (#82.12-1-2 and #82.12-2-9) the applicant presently owns.
  2. The applicant must remove the hot tub.
  3. The applicant must demolish the existing 12 foot by 18 foot garage on the adjacent parcel #82.12-2-9.
  4. Stipulations 1, 2, and 3 must be completed within 90 days of the earlier of either:
    1. The date of an Adirondack Park Agency letter acknowledging referral of variance (no reversal).
    2. The 30-day review period expires without a response from the Adirondack Park Agency.
  5. The garage to be built across the street on #82.12-2-9 is limited to 28 foot by 30 foot.
