Notice of Decision in the Matter of a Request for a Variance for

Application Number #Z2018-11

Owner: Christopher & Lucia Maddalone 525 Union Street Schenectady NY 12305

of the property located at: 108 Montayne Lane Caroga Lake NY 12032

and identified as parcel # 83.9-2-25

for a variance to the Town of Caroga Zoning Ordinance which is in violation of Article 4 Sections 4.050 and 4.101 of said code.

Owner Desires to: demolish existing structure and build a single family dwelling. The lakefront setback and lot coverage are at issue.

PLEASE TAKE NOTICE: that a meeting of the Zoning Board of Appeals of the Town of Caroga was held on November 20, 2018

The Zoning Board of Appeals application in the above matter was TABLED. During the October 23, 2018 hearing, applicants' neighbor Eugene Mierzwa orally disputed applicants' stamped survey. The ZBA then tabled the application and requested that Eugene Mierzwa and his surveyor work with applicants' surveyor, Ferguson and Foss, to resolve this matter. At the November 20, 2018 hearing, applicant claimed that no action had been taken by Eugene Mierzwa and his surveyor. Nor did Eugene Mierzwa appear before the ZBA during this November 20, 2018 hearing. Thus, the ZBA decided to table this matter and give Eugene Mierzwa one last opportunity, (30 more days) to obtain a stamped survey substantiating Eugene Mierzwa's claim regarding a lot line shared with the applicant. The ZBA took this action because of its potential impact on side setback issues. The ZBA voted to issue a letter to Eugene Mierzwa notifying him of this deadline to obtain a stamped survey documenting his claim and convey said survey to the ZBA.
