Notice of Decision from the Zoning Board of Appeals

Date: March 30, 2021

A Public Hearing before the Zoning Board of Appeals of the Town of Caroga was held on March 30, 2021 at 7:00 pm via tele-conference in compliance with NY Governor Andrew Cuomo’s Executive Orders 202.1 and 202.15, and extended through April 16, 2021 with Executive Order 202.97. Application Number Z2021-02 by Brian O’Connor, 357 South Greenhaven Road, Stormville NY 12582, is for the property located at 273 Fisher Road and identified as parcel 83.-1-15.5 in Caroga R-15 zoning district, APA Rural Use land use classification.

The applicant would like to demolish and rebuild an existing 120 square foot porch. Additionally, the applicant would like to extend said porch 25.5 feet, along the front side of the camp.

Article 4, Section I, Subsection B; District Regulations governs. A variance to the Zoning Ordinance is needed for the following two reasons:

  1. Porch would be placed within the required front yard setback. Setback requirement is 50 feet; porch is setback at 5 feet, which would be over by 45 feet.

  2. Porch would be placed within the required side yard setback. Setback requirement is 25 feet (corner lot); porch is setback at 8 feet, which would be over by 17 feet.

The variance was granted.
