Zoning Board of Appeals January 8, 2019 Minutes

Chairperson Douglas Purcell opened the public hearing at 7:00 pm and welcomed new member John Byrnes.

Chairperson Douglas Purcell asked if there were any corrections or additions to the minutes of the November 29, 2018 meeting. There were none. He then asked if there was motion to waive the reading and accept the minutes as published.

Kenneth Coirin moved to waive the reading of the minutes from the November 29, 2018 Zoning Board of Appeals meetings and accept them as published. Frank Malagisi seconded the motion. All were in favor.

Application Number #Z2018-11

Owner: Christopher & Lucia Maddalone 525 Union Street Schenectady NY 12305 of the property located at: 108 Montayne Lane Caroga Lake NY 12032 and identified as parcel # 83.9-2-25 for a variance to the Town of Caroga Zoning Ordinance which is in violation of Article 4 Sections 4.050 and 4.101 of said code.

Owner Desires to: demolish existing structure and build a single family dwelling. The lakefront setback and lot coverage are at issue.

Chairperson Douglas Purcell said this meeting was scheduled to reopen the application of Christopher & Lucia Maddalone, application #2018-11, which was tabled to allow the neighbors to provide documentation for a dispute over a property line. He received notice at about 3:00 pm today that Mr. Maddalone would not be able to attend for personal reasons. He told Mr. Maddalone he did not feel it was in anybody’s best interest to try to proceed without Mr. Maddalone present. He thinks there there may be other issues that would need discussion with Mr. Maddalone. He asked Mr. Maddalone if it was acceptable to table this application again: it was. He proposed to the Mr. Maddalone and to the board a reopening on January 31, 2019.

Kenneth Coirin said he was leaving January 31, 2019.

Chairperson Douglas Purcell said he had a conflict on January 29, 2019. He then proposed a January 30, 2019 meeting. All board members were comfortable with that date. He said would call Mr. Maddalone to confirm that date.

Chairperson Douglas Purcell moved to appoint Kenneth Coirin as Vice Chairperson of the Zoning Board of Appeals. Kathleen Ellerby seconded the motion. All were in favor.

Chairperson Douglas Purcell said he would accept a motion to adjourn.

Kenneth Coirin moved to adjourn. Frank Malagisi seconded the motion.

The meeting adjourned at 7:07 pm.
