Steve:

I met with Mary O'Dell of the APA yesterday at the site to inspect the wetlands delineated by North Country Ecological Serv., Inc. earlier in the year. As a result of the field review, since the on-site wetlands are smaller than 1 acre, and not contiguous with wetlands located off of the property, the APA will not take jurisdiction of the wetlands. However, the wetlands will fall under the regulatory authority of the US Army Corps of Engineers (USACE) pursuant to Section 404 of the Clean Water Act. As a result, any disturbance to the wetlands would require a permit from the USACE. Wetland mitigation is required for permanent wetland impacts that exceed 0.10 of an acre. The USACE does not regulate a 100 foot buffer surrounding the wetlands, as does the DEC outside of the Adirondack Park boundary.
