Please be advised that the proposed 8,490 square foot commercial boat storage building (P2021-11) on parcel 38.-1-28 appears to require a permit from the Agency as a Class A regional project.

Commercial Uses over 5,000 sqft in Low Intensity Use are Class A projects under section 810 of the APA Act and require an Agency permit (see attached 'APA HoHo Chart' for a summary of jurisdictional projects). Please note that there may be other reasons for Agency jurisdiction for the proposed project such as possible wetlands. Note the Agency's Jurisdictional Inquiry Process is the only legally binding way to ascertain Agency jurisdiction.

I strongly recommend that the Town advise the applicant to submit a Jurisdictional Inquiry Form or contact the Agency for next steps.
